1. About the Service

Mitkadem OS ("the Platform", "we", "us") is a SaaS marketing automation platform operated by Mitkadem Ltd., registered in Israel. The Platform provides marketing campaign management, scheduled content publishing, advertising campaign creation and optimization, and analytics services for small businesses.

Mitkadem OS manages Facebook and Instagram advertising campaigns on behalf of our clients. Our platform connects to clients' Meta business assets through the official Meta Marketing API to create ads, publish content, and optimize campaign performance with authorized access through Facebook Login.

AI-Esthetic (ai-esthetic.marketing) is the first client-facing product within Mitkadem OS, designed specifically for beauty industry professionals in Israel.

2. Acceptance of Terms

By accessing or using Mitkadem OS, including any of its products (AI-Esthetic and others), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

3. Account Registration

To use the Platform, you must create an account via Google OAuth or Facebook Login. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You must provide accurate and complete information during registration.

4. Use of Meta Platform (Facebook & Instagram)

Mitkadem OS integrates with Meta Platform APIs (Facebook and Instagram) to provide advertising campaign management and content publishing services on behalf of authorized clients. By connecting your Facebook or Instagram accounts through Facebook Login, you authorize the Platform to:

— Access and manage your Facebook Pages and Instagram Business accounts; — Create, configure, and manage advertising campaigns through the Marketing API, including campaign creation, ad set configuration, audience targeting, budget management, and ad creative optimization; — Publish ad creatives and content (images, videos, carousels, stories) to your connected accounts on your behalf; — Retrieve ad performance metrics (impressions, reach, clicks, conversions, cost per result, ROAS) to provide analytics dashboards and optimize campaigns; — Access Page Insights and Instagram Insights to analyze content performance and audience growth.

You maintain full control over your connected assets and may revoke access at any time through the Platform dashboard or your Facebook account settings.

Your use of the Platform in connection with Meta services is also subject to the Meta Platform Terms and the Meta Developer Policies. In the event of a conflict between these Terms and Meta's terms, Meta's terms shall prevail with respect to the use of Meta Platform data.

5. Data Collection and Usage

We collect and process personal data as described in our Privacy Policy. This includes information you provide during registration, data from connected social media accounts, and usage data from the Platform.

We do not sell your personal data or Meta Platform data to third parties.

6. Data Deletion

You have the right to request deletion of your data at any time. To delete your data:

— Visit our Data Deletion Request page; — Send an email to privacy@mitkadem.com with the subject "Data Deletion Request"; — Remove the Mitkadem application from your Facebook account settings; — We will process your request and delete all your personal data, content, and connected account data within 30 days.

Upon account deletion, all associated data — including generated content, connected social media tokens, ad campaign data, analytics data, and onboarding information — will be permanently removed from our systems.

7. Content and Advertising

The Platform creates marketing content and manages advertising campaigns on your behalf. You acknowledge that:

— Content and ads may require your review and approval before publication; — You are solely responsible for advertising content published through your connected accounts; — The Platform does not guarantee specific advertising results or return on ad spend; — You must comply with Meta's advertising policies and community guidelines; — You retain ownership of content created specifically for your business.

8. Subscription and Billing

Access to the Platform's features requires a paid subscription at 99₪/month (or as otherwise specified at the time of purchase). Payments are processed through authorized Israeli payment providers. Subscription terms, including cancellation and refund policies, are presented during the checkout process.

Advertising budgets for Meta campaigns are separate from the subscription fee and are managed directly through your connected Meta advertising account.

9. Prohibited Uses

You agree not to use the Platform to: publish illegal, defamatory, or harmful content; violate the rights of third parties; distribute spam or misleading advertising; attempt to access the Platform's systems without authorization; use the Platform in any way that violates Meta's community guidelines or advertising policies; or resell access to the Platform without written consent.

10. Limitation of Liability

The Platform is provided "as is" without warranties of any kind, whether express or implied. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to loss of revenue, data, or business opportunities. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

11. Termination

You may cancel your subscription at any time. Upon cancellation: — Access to the Platform's features will continue until the end of the current billing period; — All connected social media tokens will be revoked; — Your data will be retained for 30 days after cancellation, then permanently deleted; — You may request immediate data deletion at any time.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the modified terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Israel. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Israel.
